2025.04.17國昌質詢｜海委會行政法人如何避免淪為國安破口 惡質廠商得標海巡防彈背心 ｜海洋科技營運中心設置是否有安全查核問題與國防隱憂？海巡署防彈背心圍標案竟有中國進口纖維布涉嫌偽造MIT標籤

#國昌質詢 今日海洋委員會提出「國家海洋科技營運中心設置條例草案」，希望透過設置行政法人達到發展本土關鍵技術、維護國防資料安全及避免機密資訊外洩等效益，因此，未來對於該中心人員安全查核相當重要。針對我詢問之後由哪些機關負責「一般安全查核」或「特殊安全查核」，海委會副主委完全搞不清楚狀況。

我提醒海委會，之前數發部《國家資通安全研究院設置條例》授權訂定之《國家資通安全研究院人員安全查核辦法》第4條規定，一般安全查核由資案院辦理，特殊安全查核由數發部辦理。

然而，特殊安全查核包含資安院人員有無「動員戡亂時期終止後，曾犯內亂罪、外患罪，經有罪判決確定或通緝有案尚未結案」之情形，數發部遭外界詬病，根本沒有能力進行特殊安全查核。因此未來負責辦理國家海洋科技營運中心安全查核的機關及相關子法必須審慎研訂，避免淪為共諜滲透破口。

此外，針對2021年海巡署345萬防彈背心採購案，得標廠商及其供應商涉及法務部調查局防彈背心圍標案遭判刑，屢遭依法刊登拒絕往來廠商並停權，更離譜的是，該廠商之供應商在國防部高達3億元的抗彈纖維布標案中，自中國進購布料、改標偽造為MIT  遭判刑2年，對此，我要求海巡署徹查是否涉及相同情形。

Today, the Ocean Affairs Council(海洋委員會) proposed the draft legislation for the Act for the Establishment of the National Marine Science and Technology Operations Center(國家海洋科技營運中心設置條例草案). The primary objective of this initiative is to create an administrative legal entity that will drive advancements in critical domestic technologies, enhance national defense data security, and prevent the leakage of confidential information. Given these responsibilities, it is imperative that the center implements rigorous personnel security checks moving forward.

When I inquired about the agencies responsible for conducting "general security checks" and "special security checks," the Vice Minister of the Ocean Affairs Council was unable to provide a clear answer.

I reminded the Council that, in accordance with Article 4 of the Regulations on Special Checks of National Institute for Cyber Security Personnel(國家資通安全研究院人員安全查核辦法)—authorized by the Ministry of Digital Development’s Act for the Establishment of the National Institute of Cyber Security(國家資通安全研究院設置條例)—general security checks fall under the purview of the National Institute of Cyber Security(國家資通安全研究院), while special security checks are the responsibility of the Ministry of Digital Affairs(數位發展部).

However, it is worth noting that special security checks also entail verifying whether personnel from the National Institute of Cyber Security have, after the termination of the period of the National Mobilization for Suppression of the Communist Rebellion(動員戡亂時期), committed crimes such as sedition or treason(offenses against internal and external security), been convicted with final judgments, or are listed on wanted lists for unresolved cases. Despite this, the Ministry of Digital Affairs has faced external criticism for its inability to effectively conduct these special security checks. Given these complexities, it is crucial that the agency responsible for security checks at the Taiwan Ocean Research Institute(TORI,台灣海洋科技研究中心), along with its associated regulations, be thoroughly examined to prevent any potential vulnerabilities that could be exploited for espionage.

Furthermore, regarding the 2021 procurement case involving 3.45 million TWD worth of bulletproof vests by the Coast Guard Administration(OAC,海洋委員會海巡署), the winning contractor and its supplier were implicated in a bid-rigging scandal, investigated by the Ministry of Justice Investigation Bureau(法務部調查局), and subsequently sentenced. These entities were repeatedly blacklisted and had their rights suspended in accordance with the law. More disturbingly, the supplier involved in the procurement was also implicated in a separate case involving the Ministry of National Defense(國防部), where they imported anti-ballistic fabric(Bullet Proof Fabric) from China, falsified labels, and falsely labeled the products as "Made in Taiwan." The supplier was sentenced to two years in prison for these actions. In light of these events, I have urged the Coast Guard Administration to conduct a thorough investigation to determine whether similar issues are present in their operations.
