#國昌質詢 軍公教調薪機制無納入基層代表、欠缺法律依據,早已備受外界批評。去年,人事行政總處承諾會研擬法制化,並於年底將法案送至立法院,蘇俊榮人事長更信誓旦旦掛保證「不會跳票」,但已經2025年,請問法案在哪?

讓人不敢置信的是,自己做的承諾沒有兌現,人事長竟然厚著臉皮把皮球踢給行政院,稱已經送行政院審查,要等行政院的議程,真的是讓人嘆為觀止!何況,今日人事行政總處的業務報告也沒有要推動軍公教調薪機制的法制化,難道是在打假球?

此外,去年3月,人事長為過去多年《公務人員安全及衛生辦法》修正毫無作為而道歉!好不容易,今年2月保訓會預告安衛辦法的修正,但這個修正真的足夠保護公務員嗎?

具體而言,草案規定各機關不得因公務人員提起職場霸凌申訴而予不利益的處分或措施,但若申訴職場霸凌遭追殺,根本沒有任何法律效果!人事長說,可以提起救濟,但即使沒此規定本就可提起救濟,難道條文是寫好看的?再次證實2021年保訓會的委託研究報告早已點出之關鍵,安衛辦法無罰則根本沒有用!

Translation:
The mechanism for adjusting salaries for military personnel, civil servants, and educators has long been criticized for excluding grassroots representatives and lacking a solid legal foundation. Last year, the Directorate-General of Personnel Administration (DGPA, 人事行政總處) pledged to draft legislation and submit it to the Legislative Yuan (立法院) by the end of the year. Minister Su Chun-Jung (蘇俊榮) even guaranteed that the promise would be fulfilled. However, as 2025 unfolds, the question remains: where is the proposed legislation?

What is even more remarkable is that Minister Su, having failed to deliver on his commitment, has audaciously shifted the blame to the Executive Yuan (行政院), claiming that the proposal has been submitted for review and is simply awaiting scheduling. This is, frankly, astonishing. Furthermore, the DGPA's work report today makes no mention of advancing the legalization of the salary adjustment mechanism for military personnel, civil servants, and educators. Could this be a deliberate diversion?

In March of last year, Minister Su also apologized for the lack of progress in amending the Public Servants'Safety and Health Protection Act(公務人員安全及衛生防護辦法) over the years. After much effort, the Civil Service & Training Commission (公務人員保障暨培訓委員會) pre-announced amendments to the regulations in February of this year. But are these amendments truly sufficient to protect civil servants?

The draft stipulates that agencies must not impose unfavorable consequences or measures on civil servants who file complaints about workplace bullying. However, if such complaints lead to retaliation, the regulations would have no legal effect. Minister Su mentioned that relief measures could be sought in such cases, but these measures could already be pursued without the new provision. Does this mean the provision is merely for show? This once again highlights a key issue raised in the 2021 commissioned research report by the Civil Service & Training Commission: without penalties, the Occupational Safety and Health Regulations remain fundamentally ineffective.
