具體而言,國安會秘書長吳釗燮長年心腹何仁傑涉犯國安法遭羈押,國安法明文規定處罰過失犯,檢調卻遲未對吳釗燮啟動搜索與約談,辦案可以如此雙標?
更離譜的是,何仁傑明明屬於國家機密保護法第26條的列管對象,能接觸相關的國家機密,也為法務部調查局應辦理特殊查核之對象,但從2016年至2024年,何仁傑竟然僅於2016年5月辦理一次特殊查核,陳白立局長也承認,何仁傑後續兩次更動職務用人機關未依法提報查核,安全查核機制根本形同具文!
不僅如此,同樣涉入共諜案遭羈押的賴清德總統辦公室諮議吳尚雨,陳白立局長也坦承,吳尚雨從未辦理特殊查核,能夠接觸機密業務卻沒辦理查核,依法該辦查核卻未辦,如此國家安全大破口,到底誰要負責?
此外,我詢問法務部,是否贊同加重對中國洩密的處罰?可笑的是,號稱抗中保台的民進黨政府,鄭銘謙部長卻連基本立場都不敢表達,難道是因為第九屆修法時,民進黨團及時任法務部長邱太三大力反對,把加重對中國洩密的處罰封殺,法務部不敢支持?

Last year, Minister of Justice Cheng Ming-chien(鄭銘謙) ordered a more rigorous approach to investigating national security cases. Today, the Ministry of Justice(法務部) released a report identifying three major categories of serious national security threats. Yet conspicuously absent were issues such as "pro-China seduction" and "pro-Communist infiltration into government and party institutions." Are these scenarios deliberately excluded because they are politically inconvenient or too sensitive to confront?
A particularly glaring example is the case of Ho Jen-chieh(何仁傑), a formerly trusted longtime subordinate of National Security Council Secretary-General Joseph Wu(吳釗燮), who was detained for violating the National Security Act(國安法). The Act clearly outlines penalties for negligence, yet investigators have notably delayed searching or questioning Joseph Wu. Can the integrity of a national security investigation be preserved under such blatant double standards?
Even more troubling is the fact that Ho Jen-chieh, as someone falling under Article 26 of the Classified National Secrets Acts(國家機密保護法) and possessing access to highly sensitive national secrets, should have undergone mandatory special security checks by the Ministry of Justice Investigation Bureau(法務部調查局). Shockingly, between 2016 and 2024, he underwent only one such check, back in May 2016. The Ministry of Justice Investigation Bureau Director-General Chen Pai-li(陳白立) acknowledged that Ho's subsequent two job transfers were never reported, as required by law, for additional checks. This suggests that the security clearance mechanism has been reduced to little more than a rubber-stamp formality.
The situation becomes even more alarming when we consider Wu Shang-yu(吳尚雨), a consultant in President William Lai's office, who was also detained for alleged involvement in an espionage case. Director-General Chen Pai-li(陳白立) admitted that Wu never underwent a special security check, despite his access to classified operations. Such oversight represents a stunning lapse in national security protocol. Who, ultimately, will be held accountable for these systemic failures?
Moreover, when asked whether the Ministry of Justice supports tougher penalties for leaking secrets to China, the response was ambiguous and noncommittal. How can a government, led by the Democratic Progressive Party(DPP)—which claims to be steadfast in its opposition to China and unwavering in its defense of Taiwan—fail to take a clear stance on such a fundamental issue?
It's worth recalling that during the ninth legislative amendment, the DPP caucus and then-Minister of Justice Chiu Tai-san(邱太三) strongly opposed stricter penalties for espionage related to China, effectively sabotaging the proposal. Is this why the Ministry of Justice now hesitates to support harsher measures? Is it political fear, or an institutional unwillingness to uphold the very values the government claims to defend?
