台北地方法院今天(4/17)召開柯文哲案準備程序庭，柯文哲辯護律師當庭提出檢方在訊問過程中，出現的惡形惡狀，包含不正訊問、恐嚇威脅，甚至隱匿有利證詞的行徑，台灣民眾黨批評，北檢偵辦此案過程中，違法濫權偵訊行為不計其數，已經為台灣的司法正義蒙羞！

🔺 #林俊言是檢察官還是黑道？竟恐嚇被告「我們就試試看！」

首先，林俊言到底是檢察官還是黑道？竟然在訊問同案被告邵琇珮時，出現「如果妳還是按照廉政署這樣的說法，覺得很可以呼嚨過去，我們就試試看！」在邵琇珮已承受巨大心理壓力時，仍出言恐嚇對方，完全忽略邵琇珮所提出依法行政的證詞，而這些證詞竟然也都沒有出現在筆錄裡，顯不可信。

🔺「假會談真逼供」檢恐嚇彭振聲：「你甘願做李述德？」

第二，偵訊沒有全程錄音錄影，檢察官竟用該時間是「會談」來卸責！檢察官林俊言在去年9月3日偵訊同案被告彭振聲，長達4個多小時的時間，卻只有逾2小時的錄音錄影，在中途休息後，彭振聲就認罪了，且彭振聲在認罪前，根本不知道自己違反什麼法令。辯護律師勘驗錄音錄影後更發現，檢察官不斷恐嚇彭振聲「你現在甘願做余文就對了，你要做李述德？」甚至預設立場壓迫彭振聲：「你被賣了你都不知道！」抹黑暗示柯文哲賣了彭振聲。彭振聲認罪後隔天，依舊認定依照程序，沒有圖利，竟遭檢察官威脅：「那昨天說的都不算數囉」

台灣民眾黨批評，偵訊時沒全程錄音錄影，已經是重大違失，檢察官今天竟然還能大言不慚的辯解有一段時間是「會談」，這和過去「視察」沈慶京手法一模一樣，檢方「假視察、真訊問」「假會談，真逼供」，為自己的非法訊問脫罪。

🔺公務員認依法行政 檢卻隱匿有利證詞

第三，林俊言說詞反覆，碰到柯文哲，合法都變成非法。當台北市公務員清楚告知「在京華城之前，大家都認為都市計畫可以給獎勵」、「細部計畫要可給予容積獎勵是可以的」，檢察官林俊言在訊問過程中也都認同，但這些有利證詞卻都沒記載在筆錄裡面，明顯是刻意隱匿，最後卻曲解、誤解，羅織柯文哲罪名，真正說詞反覆的是林俊言，究竟是什麼力量，讓林俊言把合法都扭曲成非法，就是要起訴柯文哲？

🔺不公開非法偵訊畫面 檢卻要求勘驗不雅影片！

面對上述的指控，檢方當庭承認有瑕疵，仍以「字句上有落差，不影響全文意旨」來避重就輕，不願勘驗錄音錄影，但卻執著在非關本案的不雅影片，要求勘驗硬碟和光碟。柯文哲蒙受不白之冤，還要在法庭上被檢察官抹黃，不敢公開偵訊畫面，卻要求勘驗非關案情的不雅影片硬碟，台灣民眾黨痛批，#檢察官變成政治打手，不惜將司法官所受的嚴謹訓練踩在腳底下！

The Taipei District Court convened a preparatory hearing on April 17 regarding the case involving Taiwan People's Party(TPP) former Chairman Ko Wen-je(柯文哲). During the proceedings, Ko's defense team accused the prosecution of serious misconduct, including coercive interrogation tactics, intimidation, and the suppression of exculpatory testimony. The Taiwan People's Party strongly criticized the Taipei District Prosecutors Office, alleging widespread violations of legal procedure and labeling the behavior as a stain on Taiwan's judicial integrity.

•Is Lin Chun-yen a Prosecutor or a Gangster? Threatening Co-Defendant with "Don't you dare."

The TPP raised pointed questions about the conduct of Prosecutor Lin Chun-yen(林俊言), likening his actions to those of a gangster rather than a legal officer. During an interrogation of co-defendant Shao Hsiu-pei(邵琇珮) who is  the former Taipei Urban Planning Commission executive secretary, Lin allegedly issued a veiled threat: "If you continue with the the Agency Against Corruption's(廉政署) version, thinking you can bluff your way through, don't you dare.” Despite Shao showing signs of intense psychological pressure, Lin allegedly ignored her testimony affirming the lawfulness of administrative actions and omitted this crucial account from the official interrogation records—raising serious concerns about procedural fairness and the integrity of the evidence.

•"Fake Informal Interviews, Real Coercion": Intimidation of Pong Cheng-sheng

In another troubling incident, the prosecution reportedly failed to fully record an interrogation session under the guise of a "Informal Interview." On September 3 of the previous year(2024), Lin Chun-yen interrogated co-defendant Pong Cheng-sheng(彭振聲) for more than four hours, yet only two hours were officially documented. Following an unrecorded break, Pong confessed—despite later stating he was unaware of any legal wrongdoing.

Recordings revealed Lin had pressured Pong with statements such as "Do you want to be Yu Wen(余文) or  Lee Sush-der(李述德)?" and "You don't even know you've been sold out," insinuating betrayal by Ko Wen-je. When Pong later reaffirmed that he had followed proper procedures and received no illicit benefits, Lin reportedly responded with intimidation: "So what you said yesterday doesn't count anymore?" The TPP condemned the failure to record the full interrogation, accusing the prosecutor of using “fake informal interviews, real coercion”to avoid accountability for unlawful tactics.

•Civil Servants' Testimony Concealed: Prosecutor Distorts Lawful Actions

Further allegations center on the suppression of favorable testimony from Taipei City civil servants. Witnesses affirmed that, prior to the Core Pacific City (京華城) project, it was widely understood that urban planning allowances could include building bulk reward. One official stated, "Before the Core Pacific City project, everyone believed urban planning could include incentives," while another clarified that "detailed plans could allow for building bulk ratio bonus." Although Prosecutor Lin reportedly acknowledged this understanding during questioning, he failed to include these favorable statements in the official records. The TPP accused Lin of deliberately omitting critical testimony and manipulating facts to construct a false narrative of illegality surrounding Ko Wen-je's administrative decisions.

•Prosecution Dismisses Flawed Tactics as "Minor Discrepancies” While Seeking Irrelevant Evidence

In response to the mounting allegations, the prosecution conceded to certain procedural flaws but minimized them as "minor discrepancies in wording that do not affect the overall meaning." However, they refused to disclose the full interrogation footage, while simultaneously requesting access to unrelated explicit videos. The TPP denounced this as an effort to divert public attention and defame Ko Wen-je, accusing prosecutors of abandoning legal neutrality to act as political enforcers—thereby undermining the professional standards of Taiwan's judiciary.
